Federal Court Invalidates California?s Low Carbon Fuel Standard

U.S. District Judge Lawrence O?Neill has ruled that the California Air Resources Board?s pioneering Low Carbon Fuel Standard, a key component of California?s multifaceted strategy to reduce the state?s aggregate greenhouse gas emissions under AB 32, is unconstitutional.? In his December 29th ruling in Rocky Mountain Farmers Union v. Goldstene, the Fresno-based federal judge issued an injunction preventing CARB from implementing the LCFS.? But that same ruling allows CARB to pursue an immediate appeal of the decision before the U.S. Court of Appeals for the Ninth Circuit.? CARB is expected to do so.

In invalidating the LCFS, Judge O?Neill agreed with industry groups who argued that the CARB rule violates the Commerce Clause of the U.S. Constitution by impermissibly interfering with and discriminating against interstate commerce.? A principal industry objection to the LCFS is that it discourages California fuel marketers from relying on corn-based ethanol, which is primarily manufactured in the Midwest.? Corn-based ethanol?s competitive disadvantage under the CARB regulation is exacerbated by the fact that the LCFS incorporates a ?life-cycle GHG emissions assessment,? which means that emissions associated with transporting out-of-state fuels to California markets are part of the fuels? carbon content for purposes of calculating emissions under the LCFS.

Judge O?Neill?s lengthy decision concludes that CARB?s LCFS ?overtly discriminates against interstate commerce.?? Under established dormant Commerce Clause principles, that means measure is unconstitutional unless the LCFS ?substantially serves a legitimate local purpose?; and that purpose ?cannot be served as well by available, non-discriminatory means.?? The district court ruled that California met the first test, but failed the second; alternative strategies such as a carbon tax could conceivably be substituted for the LCFS, according to Judge O?Neill.

The district court ruling is CARB?s second litigation setback to its ambitious strategy to implement AB 32.? Earlier this year, a California state court judge ruled that CARB had violated the California Environmental Quality Act by not completing a legally-adequate environmental analysis of its controversial cap-and-trade program.? (CARB has since remedied that perceived deficiency.)

While Judge O?Neill?s ruling enjoins implementation of the LCFS, CARB may well ask the Ninth Circuit to lift the injunction while it considers CARB?s appeal of the district court ruling.? In any event, the district court decision doesn?t affect other aspects of CARB?s AB 32 implementation strategy, several of which are scheduled to take effect on January 1st.

I?ve long believed the dormant Commerce Clause argument embraced by the district court in Rocky Mountain Farmers Union to be the most formidable constitutional argument confronting California?s regulatory efforts to reduce the state?s aggregate greenhouse gas emissions.? Judge O?Neill?s decision is likely to encourage further invocations of that particular constitutional theory in future climate change litigation brought against California regulators.

The December 29th federal court ruling striking down the LCFS is actually only one of three opinions issued by Judge O?Neill in the same litigation on the same date.? The second concludes that the LCFS also violates dormant Commerce Clause principles because it discriminates against out-of-state and foreign crude oil while giving an economic advantage to in-state crude oil.? Judge O?Neill?s third ruling preliminarily rejects CARB?s argument that its LCFS is shielded from dormant Commerce Clause and federal preemption challenges by express provisions of the federal Clean Air Act.

Munchak: No interest in being Penn State head coach

Photo: N/A, License: N/A, Created: 2011:10:09 13:39:55

ASSOCIATED PRESS FILE Mike Munchak is in his first year as head coach of the NFL's Tennessee Titans.

Penn State's next head coach evidently won't be from Scranton.

It won't even be the man reported by some media outlets to be the search committee's top target.

Mike Munchak says he's happy where he is, thank you very much.

In his strongest comments to date on the speculation that his hiring as Penn State's next head coach might be imminent, the Tennessee Titans head coach and Scranton native said Wednesday he has "no interest" in succeeding Joe Paterno as the Nittany Lions' head coach next season.

"I love my alma mater, but I have no interest in being the head coach at Penn State," Munchak told The Tennessean. "I never want to leave Tennessee. I have a great deal of respect for Penn State, and I hope they find a great coach there. But I am happy where I'm at."

Despite rampant speculation that Munchak's loyalty to Penn State might lead him back to Happy Valley to contribute in the aftermath of the Jerry Sandusky scandal that led to the firings of Paterno and university president Graham Spanier, as well as perjury charges against athletic director Tim Curley, it appears to be loyalty that will keep him away. Munchak has been part of the Titans organization since 1982, when owner Bud Adams and the then-Houston Oilers drafted him in the first round after a stellar career as a guard with the Nittany Lions.

The Scranton Central graduate is one of the organization's greatest icons. In 2001, he was inducted into the Pro Football Hall of Fame, and after spending more than a decade as the Titans' offensive line coach, he achieved his dream of becoming an NFL head coach in February when Adams hired him to replace longtime Titans coach Jeff Fisher.

Munchak is one of just five Penn State players to be inducted into the Pro Football Hall of Fame, and he's the only former Penn State player ever to be named a head coach in the NFL.

In his first season, the Titans are 8-7 and still alive in the race for the second wildcard berth in the AFC heading into the final weekend of the regular season.

For his part, Munchak - who has a three-year contract with the Titans - said he has not talked to anybody at Penn State about the opening or the coaching search, in spite of reports that he might indeed have been at the top of the wish list for acting athletic director Dave Joyner and the search committee. Committee members have been tight-lipped in regards to the coaching search over the last several weeks, and few coaches have publicly acknowledged their interest in the job, never mind interviewing for it.

Interim coach Tom Bradley has interviewed, as have quarterbacks coach Jay Paterno and co-defensive coordinator Larry Johnson. A pair of Green Bay Packers assistants - quarterbacks coach Tom Clements and former Penn State and Pittsburgh Steelers safety Darren Perry - have said they would like to be considered.

Initially, Joyner said he hoped the coaching search would be completed before the bowl game, but in a statement released last week, he preached patience, saying a deliberate search was necessary to ensure the right coach would be hired. According to sources, it appears the earliest the university would introduce a new coach is the first week of January.

It appears that whoever that coach is won't be the man considered by so many to be the front-runner.

"It is not like I'm saying I want nothing to do with Penn State," Munchak told The Tennessean. "I am interested in what happens there, and I don't want to distance myself from Penn State.

"My point is, I have no interest in being the head coach there."

A's trade Bailey, Sweeney to Red Sox (AP)

OAKLAND, Calif. ? The Oakland Athletics traded All-Star closer Andrew Bailey and outfielder Ryan Sweeney to the Boston Red Sox on Wednesday for outfielder Josh Reddick and prospects Miles Head and Raul Alcantara.

In the deal, first reported by ESPN, new Red Sox manager Bobby Valentine has found a reliable ninth-inning guy in Bailey to replace the departed Jonathan Papelbon, who signed a $50 million, four-year contract as a free agent with the Philadelphia Phillies in November.

Bailey ? the 2009 AL Rookie of the Year who made the All-Star team that season and again in 2010 ? has been the subject of trade talk this offseason.

The right-handed Bailey, 27, went 0-4 with a 3.24 ERA and 24 saves in 41 2-3 innings this year. He spent time on the disabled list for the second straight season, pitching for the first time in 2011 on May 29 after being sidelined with a strained right forearm.

Bailey becomes the fourth key pitcher traded this month for the rebuilding A's, who dealt starter Trevor Cahill and reliever Craig Breslow to the Arizona Diamondbacks on Dec. 9 and then sent left-handed starter Gio Gonzalez to Washington last Thursday.

Reddick will look to fill a big void in Oakland's open outfield.

The 24-year-old Reddick batted .280 with seven homers and 28 RBIs in 87 games for Boston in 2011. He can play any outfield spot and likely will get immediate action for the A's, who already lost outfielders David DeJesus and Josh Willingham in free agency. Center fielder Coco Crisp isn't expected to return either.

Oakland general manager Billy Beane is retooling his roster for the future in hopes of the franchise getting the go ahead to build a new ballpark some 40 miles south in San Jose despite the San Francisco Giants owning the territorial rights to technology-rich Santa Clara County. Beane and owner Lew Wolff have said they expect to hear soon from Commissioner Bud Selig, and Beane said the unsettled stadium situation would affect him being able to sign his own free agents this winter.

The A's (74-88) haven't posted a winning record or earned a playoff berth since being swept in the 2006 AL championship series by Detroit.

At last summer's trade deadline, the A's and Red Sox were near completion on a deal that would have sent Oakland right-hander Rich Harden to Boston for Triple-A first baseman Lars Anderson but it fell through late because of Harden's lengthy list of injury issues.

Former Red Sox pitching coach Curt Young returned to the A's this offseason to work under manager Bob Melvin

India?s Most Valuable Firm? Hello TCS, Move Over RIL

The last stock market session of the year delivered an unexpected headline: Mukesh Ambani no longer runs India?s most valuable company.

Reliance Industries Ltd., his oil to retail conglomerate, was stripped of that title by Tata Consultancy Services, the outsourcing behemoth that is part of the Tata Group, according to data released by SMC Global Securities Ltd. Reliance?s market value reached 2.269 trillion rupees (about $42.8 billion) while TCS?s market value touched 2.272 trillion rupees in Friday trading.

Of course, come Monday, Reliance could regain the crown. But the news nonetheless may make for a slightly anticlimactic end of year for Mr. Ambani after glowing news reports this week about the possibility that he and his brother, Anil, have settled their famous differences. The two men, and their mother Kokilaben, attended a celebration in Gujarat for the 80th anniversary of the birth of their late father ? a rare show of family unity. Talk of an Ambani brothers reunion has been percolating for months and speculation has grown that they will once again team up in business. We?ll reserve judgment, for now, on the likelihood of that.

But the market?s numbers are clear. Ratan Tata, the head of India?s flagship conglomerate, is now the ultimate overseer of India?s most valuable firm. It?s perhaps ironic that Mr. Ambani hasn?t been knocked from his perch by a young upstart but by a man many years his senior. Indeed, it means that Mr. Tata will go into his final year at Tata?s helm with the imaginary trumpets blaring. And it?ll fall to TCS?s management and Mr. Tata?s chosen successor, Cyrus Mistry, to ensure that TCS stays where it is.

A TCS spokesman declined comment. An RIL spokesman couldn?t immediately be reached.

Critics Consensus: Streep Carries The Iron Lady

Plus, there are some solid limited openings and plenty of Certified Fresh films in theaters this week.

Happy Holidays! This week at the movies brings no new wide releases, but we've got one hotly anticipated limited -- The Iron Lady, starring Meryl Streep as former British Prime Minister Margaret Thatcher. What do the critics have to say?

Also opening this week in limited release:

  • El sicario: Room 164, documentary about a hitman for Mexican drug cartels, is at 100 percent.
  • A Separation, a drama about the dissolution of an Iranian couple's marriage, is at 100 percent.
  • Pariah, a coming-of-age drama about an inner-city teenager who's in the process of coming out of the closet, is at 97 percent.
  • Chico & Rita, an animated musical about a longtime affair between two Cuban musicians, is at 95 percent.
  • Angels Crest, starring Jeremy Piven and Thomas Dekker in a drama about the impact of a child's death on a tight-knit small town, is at 33 percent.

And don't forget, a bunch of last week's releases -- Mission: Impossible Ghost Protocol, The Adventures of Tintin, The Girl With the Dragon Tattoo, War Horse, and Pina -- are Certified Fresh.

Rescue group in crisis mode after cat euthanized (AP)

PHOENIX ? Animal lovers threatened to pull donations to an animal rescue group and the public flooded the agency with scathing comments and calls after a man's cat was euthanized when he couldn't afford its medical care, prompting the Arizona Humane Society to go into damage-control mode Wednesday.

The group has hired a publicist, removed dozens of comments on its Facebook page and directed a team of five volunteers to respond to the overwhelming calls and emails it has received since The Arizona Republic published a weekend story about Daniel Dockery and his 9-month-old cat, Scruffy.

Dockery, a 49-year-old recovering heroin addict, told the Phoenix newspaper that he took Scruffy to a Humane Society center on Dec. 8 because she had a cut from a barbed-wire fence, an injury that he described as non-life-threatening. The agency said it would cost $400 to treat Scruffy, money he didn't have.

The Humane Society cited policy when it declined to accept a credit card over the phone from Dockery's mother in Michigan or to wait for her to wire the money. The staff said if he signed papers surrendering the cat, Scruffy would be treated and put in foster care, he said.

Instead, Scruffy was euthanized several hours later.

Dockery told the Republic that he was devastated.

"Now I've got to think about how I failed that beautiful animal," Dockery said. "I failed her. ... That's so wrong. There was no reason for her not to be treated."

He described the cat as helping him stay off drugs for more than a year, the longest he had ever been clean. He hand-fed the feline before she opened her eyes at 4 days old, giving her fresh tuna and letting her sleep on his pillow.

Stacy Pearson, who was hired by the agency specifically to deal with media questions about the cat, said Dockery's case has led to two changes. The Arizona Humane Society has set up an account, funded through donations, that would cover the costs of emergency treatment of animals whose owners need a day or two to come up with money for payments. And the group is now accepting credit card payments by phone, Pearson said.

Dozens of scathing comments have since inundated the group's Facebook page, with animal lovers demanding to know why the cat was put down. Pearson said angry comments were removed because of their content: One called for the staff to be euthanized, while another said what happened to Scruffy was murder.

Pearson said Scruffy was put down over a number of reasons, including Dockery's lack of immediate funds, a lack of veterinarians to treat her and what Pearson described as a very serious cut on Scruffy from her abdomen to her knee that went to the muscle.

She said the Arizona Humane Society at the time didn't accept credit card payments over the phone because of possible fraud and can't treat pets with only a promise from owners that they can pay the next day. She said staff had every intention of getting Scruffy the help she needed but the number of animals requiring help at the group's second-chance clinic was too much for the resources available.

If Dockery had been able to pay, Scruffy would have been treated at the facility where he brought her, Pearson said.

"There was no malicious intent to take Scruffy away from her father," Pearson said. "Pulling funding is only going to make a problem like this worse."

On Facebook, where only the agency's executive director is allowed to post comments now, Guy Collison wrote that "Scruffy's story is heartbreaking, and underscores the worst-case-scenario of need eclipsing resources available." He said that his agency has always done what's best for animals.

In less than an hour after his statement was posted, more than 100 people responded, with most slamming the agency and some defending it as doing the best it can with available resources.

Pearson said the group told Dockery on Tuesday that when he's ready for another pet, he could come in and pick one out, but he declined, telling them: "No thanks."

Samsung Repp (U.S. Cellular)

Picking up where the Samsung Gem (2.5 stars) left off, the Samsung Repp reps budget-priced, entry-level Android smartphones?for U.S. Cellular. With the classic LG Optimus U?(4 stars) now off the market, it's a good option, but you can still do better without having to spend a dime.

Design, Call Quality, and Apps
The Repp measures 4.4 by 2.3 by 0.5 inches (HWD) and weighs just 3.7 ounces. It's lightweight and comfortable to hold, and looks significantly nicer than the angular Gem. Made entirely of plastic, the textured back panel of the phone is a "wine red" color, with a silver band separating it from more red detail on the front. The 3.2-inch plastic capacitive touch screen offers 320-by-480-pixel resolution. That's standard for low-end smartphones, and while it's usually not a problem, colors here look washed out and there's a pervasive, unpleasant stippling effect. Typing on the Repp's Swype keyboard felt a bit cramped, due to the small screen size. There are three function keys below the display, instead of the usual four. Two of them are touch keys, while the home key is a physical button.

The Samsung Repp is a dual-band EV-DO Rev 0 (850/1900 MHz) device with 802.11b/g/n Wi-Fi. The Repp will hit 3G data speeds on U.S. Cellular, but it will be slightly slower than some other 3G phones, like the Samsung Mesmerize?(Free, 4.5 stars), which use the faster EVDO Rev A technology. It can also function as a mobile hotspot with the appropriate data plan.

Reception was fine and voice quality was good overall, a significant step up from the Gem. Voices sound clear and easy to understand in the earpiece, if just a touch thready. Calls made with the phone are equally clear, with good background noise reduction, though I noticed a slight ringing sound on occasion. The speakerphone sounds good and is just loud enough to use outdoors. Calls also sounded fine through a Jawbone Era?Bluetooth headset ($129, 4.5 stars), and voice dialing worked over Bluetooth without training. Battery life was good at 7 hours, 43 minutes of talk time.

OS and Apps
The Repp runs Android 2.3.5 (Gingerbread). There's no word on whether it will receive an update to Android 4.0 (Ice Cream Sandwich), but we wouldn't hold out hope. Like the Gem, the version of Android running here is virtually?stock; there are no Samsung TouchWiz-like enhancements to be found. There are five customizable home screens you can swipe between, which come preloaded with a number of useful apps and widgets, along with some bloatware. Thankfully, though, the Repp isn't saddled with much more bloatware than the typical Android device, and what's there doesn't seem to slow things down.

Everything is powered by an 800MHz Qualcomm S1 processor. It's not blazing fast, but it gets the job done for most common tasks. The Repp benchmarked similarly to other lower-end Android phones.

App-wise, you get Google Maps Navigation for free voice-enabled, turn-by-turn GPS directions, and a bit of bloatware from U.S. Cellular. You should also be able to run most of the 250,000+ third-party apps in the Android Market.

Multimedia, Camera, and Conclusions
There's a side-mounted microSD card slot on the left side of the phone, which is a plus. Samsung includes a 2GB card; my 32 and 64GB SanDisk cards worked fine as well. Music tracks sounded clear through both wired earbuds as well as Altec Lansing Backbeat?Bluetooth headphones ($99.99, 3.5 stars). I was able to listen to AAC, MP3, OGG, WAV, and WMA test files, but not FLAC. Standalone MP4 and 3GP videos played back at resolutions up to 800-by-480, and audio was fine over Bluetooth.

The 3.2-megapixel camera has no auto-focus or flash. Shutter speeds are fast, but test photos leave much to be desired. Photos taken with the camera look dark, washed out, and a bit blurry. Recorded 320-by-240-pixel videos play back at 15 frames per second; they look smooth, but they're also not much larger than a postage stamp.

Despite its weak screen and camera, the Samsung Repp is a decent entry-level Android phone for U.S. Cellular. But you can do a lot better without having to spend any money. Our previous Editors' Choice, the Samsung Mesmerize, is now free, too. It runs the same major version of Android as the Repp does, and it's powered by a faster processor, has a better camera and a much nicer display. If you're willing to spend some extra money, our current Editors' Choice, the Motorola Electrify?($99.99, 4.5 stars) will set you back 100 bucks, but you'll get an ultra fast dual-core processor, beautiful display, and the ability to convert your phone into a laptop PC with the proper accessories.

Benchmarks
Continuous talk time: 7 hours 43 minutes
