(AP) ? A Dallas-area woman has found Neiman Marcus' generous return policy lacking, saying the luxury retailer wouldn't let her return $1.4 million worth of tainted items ? many of them gifts her husband purchased from a store employee with whom he was allegedly having an affair.

Patricia Walker is suing Neiman Marcus, claiming fraud against the retailer. The lawsuit alleges that many of the items were presented as gifts to Walker from her husband, bought with Walker's credit from her long-time personal shopper, who received a hefty commission from the sales.

But Walker's attorney insists the lawsuit isn't about spite.

"This is not about revenge," Mark Ticer, Walker's attorney, said Thursday. "This is about accountability and getting them to step up and do the right thing."

Neiman Marcus spokeswoman Ginger Reeder said corporate policy prevents her from commenting on litigation. The retailer's return policy, as posted on its website, says customers may return, for credit, any items with which they "are not completely satisfied."

In court documents, Neiman Marcus and employee Favi Lo denied the allegations and said Walker's deceptive trade practices claim is groundless.

Most of the items Walker's husband, Robert "Bobby" Tennison, 65, purchased were gifts for Walker, who was seriously injured in a car accident in 2007 that put her in the hospital for months and made her homebound until well into 2010, Ticer said.

"Adding insult to injury ... it's getting charged to her Neiman's account. The bill is getting paid with her money," Ticer said.

The gifts included jewelry, glass sculptures, furs, handbags and other items the lawsuit says he bought from Lo.

The lawsuit also alleges the store knew about the illicit arrangement but did nothing to stop it because Neiman Marcus "directly profited from Lo's conduct and deceit."

Tennison and Lo did not return calls to The Associated Press.

Ticer said Walker went from spending about $100,000 a year at Neiman's with help from her personal shopper in 2006 to nearly $850,000 in 2009. Walker didn't realize what was going on until Tennison filed for divorce in 2010.

"Had Walker known of this betrayal of trust and confidence," the suit contends she never would have purchased anything from Lo or Neiman Marcus and she would not have ever authorized Tennison or Lo to do so.

"Ms. Walker had no idea it was going on at all," Ticer said. "She was in the perfect spot to be vulnerable after the horrible accident."

The lawsuit claims that Lo and Tennison "conspired on these purchases to both enable Tennison to live a lavish lifestyle that he could not afford on his own" and allow Lo to receive large commissions.

Ticer said Walker is an extremely private person who had hoped to avoid a jury trial. The lawsuit was filed in Dallas County court in September 2010. A trial date has been set for November 2012.

(AP) ? The world's first commercial supply ship is closed up and ready for a Thursday flight back to Earth from the International Space Station.

Astronauts sealed the hatch to the SpaceX Dragon capsule on Wednesday. It's loaded with 1,400 pounds of experiments and old equipment for return to NASA.

In the pre-dawn hours of Thursday, the astronauts will use the station's robot arm to release the Dragon. The spacecraft will aim for a splashdown in the Pacific later in the morning, about 500 miles southwest of Los Angeles.

The California-based SpaceX is the first private business to launch a spacecraft to the orbiting complex. NASA wants to use the capsule to restock the station's pantry and eventually ferry station astronauts.

UN: Most of 108 killed in Syria were executed

BEIRUT (AP) ? The U.N.'s human rights office said Tuesday that most of the 108 victims of a massacre in Syria last week were shot at close range, some of them women, children and entire families gunned down in their own homes.

The massacre on Friday in Houla drew new international outrage, with more than half a dozen countries including France and Britain expelling Syrian diplomats in protest in what the White House said was a sign of their "absolute disgust" with Assad's rule.

Still, spokesman Jay Carney said the White House remains opposed to military action in Syria, reasoning that would only lead to more carnage.

The U.N. peacekeeping chief Herve Ladsous also said there are strong suspicions that pro-government fighters were responsible for some of the killings.

"We are at a tipping point," special envoy Kofi Annan told reporters Tuesday in Damascus, following a meeting with President Bashar Assad. "The Syrian people do not want the future to be one of bloodshed and division."

He called on the government and the armed opposition to stop all violence.

The U.N. report indicated that most of the dead were killed execution-style, with fewer than 20 people cut down by regime shelling. The U.N. cited survivors and witnesses blaming the house-to-house killings on pro-government thugs known as shabiha, who often operate as hired muscle for the regime.

"What is very clear is this was an absolutely abominable event that took place in Houla, and at least a substantial part of it was summary executions of civilians, women and children," said Rupert Colville, spokesman for the U.N. High commissioner for Human Rights. "At this point, it looks like entire families were shot in their houses."

Houla activists reached by Skype said government troops shelled the area after anti-government protests on Friday and clashed with local rebels. Later, shabiha from nearby villages swept through the area, stabbing residents and shooting them at close range.

Videos posted online by anti-regime activists show explosions in Houla, dismembered bodies lying in the streets, then row upon row of the dead laid out before being buried in a mass grave. Some of the videos showed dozens of dead children, some with gaping wounds.

The Syrian regime has denied any role in the massacre, blaming the killings on "armed terrorists" who attacked army positions in the area and slaughtered innocent civilians. But it has provided no evidence to support its narrative nor has it given a death toll.

U.N. investigators have said they found tank and artillery shells in Houla after the attack, but stopped short of blaming regime forces for the killings.

The U.N. said that at least 108 people, including 34 women and 49 children, were killed in the attack that began on Friday and continued through the night on a group of poor farming villages northwest of the central city of Homs.

Speaking to reporters in Geneva, Colville said U.N. monitors who visited the area found that fewer than 20 of the dead were killed by artillery fire. The rest appeared to have been shot at close range.

He said information from U.N. investigators and other sources indicated that many of the victims were killed in the Houla village of Taldaw in two separate incidents. Local residents blamed the killings on pro-regime militias known as shabiha, which sometimes act "in concert" with government forces, he said.

He said a fuller investigation was needed before he could comment on that, and called on Syria to allow free access to U.N. investigators.

The brutality of the killings and the high death toll raised new questions about the ability of a U.N.-brokered plan to end the violence in Syria, which began in March 2011.

According to the state-run news agency, SANA, Assad blamed terrorists and weapons smugglers for scuttling Annan's peace plan. The regime denies there is any popular will behind the country's uprising, saying foreign extremists and terrorists are driving the unrest.

The new information provided by the U.N. draws attention to the role of the shabiha in 15 months of violence in Syria. Assad's government often deploys pro-regime thugs or armed militias to repress protests or carry out more military-style attacks on opposition areas.

They frequently work closely with soldiers and security forces, but the regime never acknowledges their existence, allowing it to deny responsibility for their actions.

A Syrian official denied again on Tuesday any involvement.

"It is irrational that any party who wants to make Annan's mission a success would ever commit such a massacre," Deputy Foreign Minister Faisal Mekdad told reporters. He said Syria remained committed to Annan's plan and "had not committed a single violation."

Activists have posted videos of tanks and armored vehicles in the middle of cities, a violation of the plan, and U.N. observers said they found spent tank and artillery shells in Houla after the massacre there. Funeral videos also showed local rebels among the mourners ? making it unlikely they carried out the killings.

Anti-regime rebels around the country regularly attack military convoys and checkpoints, killing soldiers.

Syria's international isolation deepened in response to the killings. Governments around the world expelled Syrian ambassadors and diplomats Tuesday, an unusual, coordinated blow to Assad's regime.

The United States, Britain, Canada, Australia, France, Germany, Italy, Spain and the Netherlands took action Tuesday against Syrian diplomats. Britain's foreign secretary said the countries involved in Tuesday's expulsions would also push for tougher sanctions against Syria.

Longtime Syrian ally Russia has largely stood by Damascus, although Moscow is growing increasingly critical ? particularly over the Houla massacre. On Tuesday, however, Russian Foreign Minister Sergey Lavrov accused unnamed countries of trying to use the Houla killings "as a pretext for taking military measures."

He said such nations sought to impede Annan's plan because it seeks dialogue between Syrians, not regime change.

Syria's unrest began in March 2011, with protests calling for political change. Government troops swiftly cracked down at the uprising spread, and many in the opposition have taken up arms to defend their towns and attack government troops.

Still pontificating onstage at D10, Apple CEO Tim Cook was inevitably queried by Kara Swisher and Walt Mossberg about the ongoing Apple TV rumors, though for now he only referred to the company's existing set-top box. He revealed that Apple sold 2.8 million of the hockey pucks last year and has already moved 2.7 million in 2012. As Steve Jobs did repeatedly before him, he mentioned that TV is something "many people would say that this is an area of their life that they aren't pleased with" and explained Apple's key questions: Can we control the key technology? Can we make a significant contribution beyond what others have done in this area? Will this product be one that we want?

Walt pressed for more info and even dug into the Apple TV's limited content offerings, but Cook quickly shut things down (to knowing laughs from the audience) without revealing any plans for a TV set, IPTV service or anything else. He did however say that he doesn't think Apple "has to own a content business", as Netflix, Amazon and Google are developing, indicating that it hasn't had an issue (for the most part) getting content. Delusional Paris Hilton Determined to Make New Album a Smash Hit


Paris Hilton might not want to quit her day job ... whatever that is.

Even with THG plugging it, her Oxygen reality show was canceled for abysmal ratings. You know it's bad when that happens. Now the former reality TV star decided to focus all her "career comeback" efforts on releasing a second album.

Breath? Probably shouldn't be held.

As we previously reported, Paris and Kim Kardashian are "cool" with each other ... on the surface. But she still can't believe her one-time BFF's level of fame.

After all, Paris wrote the book on getting railed on tape and turning it into nonstop celebrity gossip attention and millions of dollars. Kim just did her one better.

Or five, or 10 better. In any case, Kim is all the rage these days, while Paris' first album sold only 197,000 copies at the PEAK of her popularity in 2006.

Think the second one's going to do better?

"Paris has been working with Flo Rida, LMFAO, and David Guetta, and the album should be released this summer," says a source, anonymously of course.

"She has a lot riding on this project because her last reality show was canceled, and she needs to do something to re-invent herself. Paris is hoping to appeal to a broader fan base and would love to use the album as a platform for a possible project with MTV."

Whatever the odds of that are, bet against it.

(AP) ? President Barack Obama is paying tribute to veterans during Memorial Day weekend, honoring those willing to sacrifice their lives for their country.

Obama says in his weekly radio and Internet address he will mark Monday's holiday with veterans and their families at Arlington National Cemetery and the Vietnam Veterans Memorial.

The president says the nation needs to honor veterans, including those who served in Iraq and Afghanistan, by ensuring they have access to health care, higher education and jobs.

In the Republican address, Rep. Lynn Jenkins of Kansas says higher prices from gasoline to groceries have placed a strain on families. She is calling for building the controversial Canada-to-Texas Keystone XL oil pipeline.

BUDAPEST, Hungary (AP) -Faking injuries on the pitch could jeopardize treatment for players, who suffer cardiac arrest and other life threatening conditions, World Cup final referee Howard Webb told a FIFA medical conference.

Webb's quick reaction when Fabrice Muamba collapsed on the field in March helped the Bolton midfielder get treatment which saved his life.

Referees' responses could be affected if players "cry wolf" too often, Webb said on Thursday.

Players who are not seriously injured sometimes seek a tactical edge by staying down longer than necessary to slow the game.

"I would ask everybody in football to think about these situations and ask players not to take advantage," the English referee said.

Livorno midfielder Piermario Morosini died after suffering cardiac arrest during Italy's Serie B match in April.

Muamba's recovery after his heart stopped beating on its own for 78 minutes is "an unbelievable miracle," Webb said.

FIFA invited Webb to address a two-day gathering of medical professionals, who have received a comprehensive study of cardiac cases involving football players from the game's governing body.

FIFA's registry includes 84 players, who died after cardiac arrest in the past five years, and 23 cases of players, who - like Muamba - survived. Five sudden deaths remain unexplained.

FIFA President Sepp Blatter said more needs to be done to protect players' health.

"We have to send practically every week a letter of condolences to one of the national associations because somebody died," Blatter told delegates.

Research from 123 countries revealed the average age in cases that have resulted in death was 24.9 years. The youngest player affected was 13, according to FIFA's chief medical officer Jiri Dvorak.

Dvorak told delegates that only half of the countries surveyed required players at top-tier clubs to undergo echocardiograph tests. Heart screenings are mandatory for all players at FIFA tournaments.

Delegates raised concern over the fact that defibrillators - which are used to restart the beating of a player's heart with an electric shock - had been available only in 23 emergency cases. They cost from $600-$1,200.

FIFA delegates learnt that players will die without receiving an electric shock within three minutes of collapsing.

Webb said referees are under pressure when deciding on stopping the game and have a fallen player receive treatment. He warned players against faking pain for fear of affecting referees' judgment.

"If players and if people cry wolf too many times, then there is a possibility that maybe we will not react in the way we need to," Webb said on the sidelines of the meeting. "If we come under criticism for stopping the games too many times for doctors or physiotherapists to enter the field of play, then referees might be inclined not to stop the game."

Players' welfare is first priority, Webb said, adding that he felt a "numb sensation" after Muamba collapsed during an English FA Cup match at Tottenham.

"Without life, there is no football at all. The realization is, when the CPR starts, is just how serious it is," he said. "This story has a happy ending thanks to the expertise of the medical staff."

The crowd at White Hart Lane was "urging the doctors to get (Muamba) going again," Webb said. "It was just the most unbelievable crowd reaction I have ever experienced in football and thinking about it now is making me feel emotional."

Muamba was discharged from a London hospital on April 16, but cardiologists have not decided when he can resume playing.

Also discussed at the conference was a possibility that referees - like players - could be asked to undergo tests for banned performance enhancing drugs.

Referees are part of the game and should be treated like players, Dvorak said.

Meanwhile, the World Anti-Doping Agency asked FIFA to advise when players serving doping bans should be allowed to return to training with teammates.

Current rules under review prevent suspended players working with their teams - effectively extending their ban if they are not match-ready immediately on completion.

WADA director general David Howman acknowledged that penalties could seem harsher for team players than for individual athletes.

FIFA and WADA are also working on a biological passport to monitor players' doping samples ahead of the 2014 World Cup.

Delegates agreed that players should ideally play a maximum of 60 games each year to protect themselves against injury and issues such as osteoarthritis.

Orioles shut down Red Sox

BALTIMORE (AP) - Brian Matusz handed the baseball to manager Buck Showalter and headed off the mound, walking ever so slowly toward the Orioles dugout as many in the crowd of 25,171 stood and cheered.

The left-hander could be forgiven for soaking it all in, because the ovation was a long time coming.

Matusz allowed two hits and struck out nine in 6 1-3 innings, Steve Tolleson and Wilson Betemit both hit two-run homers, and Baltimore beat the Boston Red Sox 4-1 on Tuesday night.

It was the sixth win in eight games for the AL East-leading Orioles, who improved to 4-1 against Boston this season. Tolleson homered off Felix Doubront in the second inning and Betemit connected against Matt Albers in the eighth.

Matusz (4-4) threw his fastball with uncanny accuracy and kept the Red Sox off balance with a nasty, dipping curveball. In winning his third straight start, the 25-year-old allowed one run, walked one and matched his career high in strikeouts. He threw 101 pitches, 67 for strikes.

After striking out Adrian Gonzalez with a wicked breaking ball, Matusz was done for the night. But the fans wouldn't let him leave without thanking him for his performance with a long round of cheers.

"I had chills going through my body," he said. "It's such a great feeling to see the fans on their feet like that. You know, it really means a lot to have the support of the fans behind us. It's a pretty special feeling."

Especially for Matusz, who was 1-9 with a 10.69 ERA in a dismal 2011 that included two trips to the disabled list.

"I've come a long way since last year, when it was the opposite, when people were on their feet booing," he said. "It's really special to be able to work as I have and be able to come back and get back to being my normal self and be able to see the support from the fans. There's no better feeling."

After starting 0-3 this season, he has won four of his last five starts.

"I'm getting my confidence back," Matusz said. "Like I've said, I forgot all about last year. I look at that just as a fluke."

The left-hander certainly made an impression on the Red Sox.

"He was hitting his spots, hitting the corners, getting ahead in the count," Gonzalez said.

Darren O'Day struck out the final two batters in the seventh, Pedro Strop worked a hitless eighth and Jim Johnson got three straight outs to complete the two-hitter and earn his 16th save in as many tries.

Kevin Youkilis, who was activated from the disabled list before the game, homered for the Red Sox, who were seeking to climb over .500 for the first time this season. Instead, Boston reclaimed sole possession of last place in the AL East.

Matusz outpitched Doubront (4-2), who gave up two runs and four hits in six innings and notched a career-high nine strikeouts.

"Those things happen. Tough games," Doubront said. "I just tried to stay calm and go deep in the game. Get a chance to let our guys do the job and score some runs."

The difference was Tolleson, who came to the plate in the second inning with one home run in 62 career at-bats. With a runner on first, Tolleson sent a drive over the center-field wall.

"When I hit it, I said if that doesn't go out then I'm probably not going to hit one out," Tolleson said.

It was the first homer allowed by Doubront in five starts.

"Felix Doubront had his good stuff," Boston manager Bobby Valentine said. "A walk and a home run and he gave up two runs. He was battling the whole way. He just picked a night when the opposing pitcher had good stuff and shut us down."

Youkilis halved the lead with a shot to center in the fourth. It was his third homer of the season, the first since April 26.

Notes: Baltimore OF Adam Jones extended his hitting streak to a career-high 14 games. ... Boston 2B Dustin Pedroia had his 20-game hitting streak against the Orioles come to an end. ... The Red Sox put OF Cody Ross (broken foot) on the 15-day DL, purchased the contract of OF Scott Podsednik and moved RHP Daisuke Matsuzaka from the 15- to the 60-day DL. ... Orioles 2B Brian Roberts, who's been sidelined for more than a year with a concussion, will begin a minor league rehabilitation assignment Wednesday with Double-A Bowie. ... Orioles OF Nolan Reimold (back) will receive a second epidural shot Friday. "We're hoping this does the trick," Showalter said. ... Jake Arrieta starts for Baltimore against Daniel Bard in the series finale Wednesday afternoon.

Audyssey Audio Dock Air


Last year brought us the first AirPlay speaker systems?speaker docks that stream audio wirelessly from Apple iOS products and some computers via a Wi-Fi signal. After the Editors' Choice Bowers & Wilkins Zeppelin Air ($599.95, 4 stars) debuted Apple's integrated streaming audio technology, only a few offerings have actually been released. Joining the Zeppelin Air and the significantly less successful JBL On Air Wireless ($349.95, 2.5 stars) is the Audyssey Audio Dock Air, at $399.99 (direct). Deep bass lovers will enjoy the exaggerated low-end response of the Audyssey Dock; audiophiles will want to steer clear. Unfortunately, the dock suffers from some stream interruption issues that no one will enjoy, and this knocks its rating down a bit. An iOS update was supposed to fix these problems, but unfortunately they seem to still plague the dock.

Editors' Note (5/23/12): We retested the Audyssey to see if it's streaming problems would be solved with the latest version of iOS, and we encountered the same issues?despite seeing improvements on other speaker systems like the Klipsch Gallery G-17 Air. The rating remains the same.?

Design
Measuring 8.3 by 4.8 by 8.5 inches (HWD), the Audyssey Audio Dock resembles an upright square. Like most AirPlay docks, it has very few buttons and uses black felt to cover its drivers. It's almost as if Apple has specific design rules for AirPlay docks, so that they will all resemble a family of Apple-esque products. (If you detect sarcasm, it's because, in all likelihood, Apple is very much involved in the streamlined designs of all of these docks). The unadorned black felt speaker panels face in opposite directions, spreading the reach of the audio, for sure, but not necessarily increasing the width of the stereo field much, since both left and right channels originate from essentially the same spot once you're a foot or so away. That said, the opposite directions of the speakers can benefit from reflections off of walls in your room, and that can certainly have an effect on your perception of the stereo image, although it may not be one audio engineers will be pleased with?more on that in a bit. A matte black plastic band separates the two speaker panels. On the back end of the band, there's a connection for the included power supply, as well as a Pairing button (for initial setup) and a 3.5mm Aux input. The band's front side has a 3.5mm headphone jack, while the top panel houses a Volume control dial and two LEDs that indicate when the unit is powered up and when it is connected for AirPlay. The system ships with a 3.5mm audio cable for connecting devices to the Aux input.

Performance
Setting up the Audio Dock Air is not difficult, as the instructions are simple and laid out explicitly in the included manual. You will need a Wi-Fi connection, however, and a bit of patience, as the pairing process between devices, and the connection process to the Wi-Fi signal itself, can take a few minutes. Once complete, you are able to stream from any PC or Mac with a recent version of iTunes (beyond 10.1), and any iOS device (iPhone, iPad, or iPod touch).

AirPlay's sound quality is actually pretty impressive, with strong bass performance. The Audio Air Dock only adds to the bass experience; Even at low-to-moderate volumes, one might say it sounds "thunderous." As you boost the volume louder and louder, however, the bass signal becomes more and more compressed. Why does Audyssey do this? Well, first off, it's a process often referred to as Digital Signal Processing (DSP), and Audyssey is not alone in employing it. Bowers & Wilkins has utilized some signal processing on its consumer line as well. The basic goal is to eliminate any distortion or possibility of blowing a speaker. Deep bass frequencies at high volumes are usually the culprit when speakers distort, so the signal processing basically limits the volume of the bass as you raise the system's overall volume. At maximum volume on Bowers & Wilkins' PC speaker set, the MM-1 ($499.95, 4 stars), this ends up sounding like some serious dynamic compression, where the range of transient sounds like drum hits are squashed lower to be roughly the same volume as everything else in the mix. You've heard this before when a loud song comes on the radio and suddenly the overall volume of the song seems to dip as the heavily distorted guitars kick in.

On the Audio Dock Air speakers, however, this processing is quite noticeable, primarily because at lower-to-mid volume settings, the bass is already so boosted, that when you raise the volume high, it sounds like you're listening to a different speaker system because the bass frequencies have been so dramatically cut to prevent distortion. The good news is, this system sounds excellent?for bass enthusiasts, at least?at moderate volumes. Even when it's not really that loud, it feels loud. The bad news is, when you blast it, the signal processing steals some of the bass thunder and squashes the overall signal pretty intensely. Simply put, if you're into deep bass and listening at moderate levels, this system won't disappoint you sonically. It never really distorts, even on deep bass tracks at maximum volume, but the processing is intense enough that it can sound as if it's about to distort?a common characteristic of signal limiting at its most extreme.

Because of the placement of the speakers at opposite sides of the dock, projecting in opposite directions, the stereo image is altered a bit in a way that casual listening may not suffer from, but one channel will often appear louder than the other. Simply put, it definitely helps fill the room with sound, but this is not how records are mixed.

Of course, as I mentioned earlier, I actually like the audio performance enough that it would have had a higher rating. Not every system needs to be made for audiophiles craving flat response?there's room enough in the world for those of you who really dig thumping bass. The Audio Dock Air is made with these listeners in mind, and it brings an extra bottom end to everything from hip hop and rock to even classical music, making the lower strings in John Adams' "The Chairman Dances" sound downright ominous and intense. But we have a different issue to deal with.

Tested on a home Wi-Fi network that regularly streams audio, via AirPlay, from a iPhone and a laptop to a stereo receiver with an AirPort express connected to it, the Audio Dock Air fared differently than the aforementioned setup. This is possibly because the AirPort Express uses 802.11n wireless signal, while Apple's AirPlay and the docks that have it built-in use 802.11g. Where the AirPort Express only seems to stutter when its sound source gets out of range?say, you take your iPhone too far into the kitchen, away from the router?the Audio Dock Air stutters more often, even, at times, in close proximity to the router and the sound source. Often, the stuttering seems to occur when the Wi-Fi network performs routine tasks at the same time?say, sending an email or loading a webpage while streaming music. Occasionally, the stream would halt altogether, and the system would need to be rebooted or the phone disconnected and reconnected to the network in order to re-pair the device with the speakers. The recent Klipsch Gallery G-17 Air ($549.99, 4 stars), another AirPlay speaker dock, also suffered from the same streaming issues, but an iOS update seems to have resolved those issues on the G-17 while they remain very present on the Audyssey dock.

When you plug your device into the aux input directly, the Audyssey system offers up a bass lover's dream, but as a streaming system, it's got some issues to iron out. If you'd rather go the Bluetooth route, check out the fantastic JBL OnBeat Xtreme ($499.95, 4.5 stars), which appears as an AirPlay device on iOS devices despite using Bluetooth, and the portable Bose SoundLink Wireless Mobile Speaker ($299.95, 4 stars), both of them Editors' Choice winners for wireless speaker systems.
